This page restates the existing BIGPIQ privacy policy in the visual language of the new landing page, without changing the legal meaning.

BIGPIQ Technologies Private Limited is the owner and operator of the mobile Application named LESSs (“Mobile App” or “App” or “Platform”). The protection and security of THE USER’s personal information is our top priority. This Privacy Policy discloses practices for the LESSs Platform and subscriber / membership based services (“Services”) including the type of information being collected, method of such information collection, use of such information and sharing of such information with third parties. This Privacy Policy governs the usage of the LESSs Mobile App which is available on both Google Play Store and Apple Store.

By using this App, THE USER signifies that THE USER is capable of contracting under the Indian Contract Act, 1872 and has obtained authorization from the Owner of the Mobile Device.

FURTHER, BY USING THE APP, ITS SERVICES, YOU WILL BE DEEMED TO HAVE READ, UNDERSTOOD, AND AGREED TO THE PRACTICES AND POLICIES OUTLINED IN THIS PRIVACY POLICY AND AGREE TO BE BOUND BY THE PRIVACY POLICY. YOU HEREBY CONSENT TO OUR COLLECTION, USAGE, SHARING AND DISCLOSURE OF YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY. WE RESERVE THE RIGHT TO CHANGE, MODIFY, ADD OR DELETE PORTIONS OF THE TERMS OF THIS PRIVACY POLICY, AT OUR SOLE DISCRETION FROM TIME TO TIME. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY AND THE TERMS OF USE AT ANY TIME, YOU ARE ADVISED TO DISCONTINUE THE USAGE OF THIS APP.

1. Definitions

  1. “APP” shall refer to the Mobile Application named LESSs, which is an aggregator platform, aiming to connect the Consumer/ the Primary User with the Service Provider/ the Secondary User and is downloaded and installed from Google Play Store or Apple Store.
  2. “USER” shall refer to both the Primary User and the Secondary User.
  3. “PRIMARY USER” shall refer to the End Consumer of services provided by the Secondary Users, that are made available on the LESSs Platform.
  4. “SECONDARY USER” shall refer to the Service Provider, responsible for providing services through the LESSs Platform. A Secondary User could be a business or a commercial establishment; a company, a partnership or a sole proprietorship engaged in the business of delivering goods or services. They may also be referred to as Business Entities. For clarification, the LESSs platform intends to support various Business Entity types such as Medical Clinics, Medical diagnostic Centers, Hospitals, Pharmacy, Salons, Offices, Gym, Super Markets, Sports Centers, Educational Institutes, Service Centers (cars, bikes, electronics, etc.)
  5. “PERSONAL INFORMATION” shall refer to any information that identifies or can be used to identify, contact or locate the User, to whom such information pertains including, but not limited to, name, address, gender, phone number, email address, identification card number, as the case may be.
  6. “SERVICES” shall refer to the services provided by the Secondary User to the Primary User on the Platform. The LESSs platform offers a three-layered interaction between the Primary User and the Secondary User. First, the Primary User attempts to book a time slot with the Secondary User, upon selection of a desired service. Second, The Primary User fills in the particulars required to book a slot in the Application Form. Third, the Primary User submits the request to avail of a confirmed slot. The Secondary User then, processes requests on the basis of priority and waitlist numbers before allotting a slot to the Primary User.
  7. “PLATFORM” shall refer to both the Website www.bigpiq.com and the App specified in Clause 1(a).

2. Collection of Personal Information

  1. In general, our services require both the Primary and Secondary User’s name and phone number for registration and sign-in and also for the purpose of issuance of token.
  2. As a primary user of the LESSs Platform, when you use any of the services, you might be requested to provide your details such as Name, Age, Address, ID proof, etc. This information is only accessible by the targeted Secondary User and will not be seen or used by any other user (Primary or Secondary). It’s left up to the discretion of the Primary User to choose the desired service, at their own free will, after carefully verifying the Secondary User who is offering the said service. BIGPIQ Technologies Private Limited does not make any verification check for the Secondary Users registered on the LESSs Platform. Hence, the Primary Users are advised to choose the desired services after a thorough consideration and verification of the details provided thereupon.
  3. Upon the selection of a service by a Primary User, the LESSs Platform launches the UPI payment app in order to facilitate a contact-less payment to the Secondary User for the chosen service. The LESSs Platform does not track the payment that is made by the Primary User for the services availed. It simply indicates the amount with respect to the services available and launches the UPI payment app, upon selection of a service, for payment.
  4. The LESSs Platform needs to know your device location only when a Primary User performs a location-based radius search to locate any Secondary User near them, in order to avail a desired service by either attempting to book a slot or raise any request.
  5. The LESSs Platform automatically detects the City, State and Zip Code based on the IP address of the User when the said User logs into the Platform for the first time. Note: We do not store or track geo-coordinates of your device location on our platform. Rather, we simply use it for locating the Business Entities/Secondary Users near you when the explicit "search" action is performed by you.
  6. Some of the Secondary Users (For instance, administrators of physical entities such as Shops, Offices, Apartments or any other Businesses, etc.) will be required to provide public-facing information to facilitate the discoverability and accessibility of their services by the Primary Users of the platform. This information will be available to all users on the Platform and may be used to identify a particular Secondary User/ Business Entity. Further, it will be the discretion of the Administrator / Manager / Owner of a particular Secondary User/ Business Entity to add or remove information about other Administrators/Managers belonging to their Business Entity, who may or may not be registered users on the Platform.
  7. You, as a Secondary User, hereby consent to the collection of such public-facing information. Without prejudice to the generality of the above, information collected by us from you may include (but is not limited to) the following:
    1. Basic Details:
      • Name of the Establishment
      • Registration Number
      • Contact Number
      • Contact Email Id
      • WhatsApp number
      • Other details of the Entity
    2. Booking Details:
      • Mobile number (for online consultation)
      • Opening Time and Closing Time
      • Duration of Break Time
      • Days on which offering of services is closed
      • Duration of time for a particular slot
      • Number of days in which advance booking is allowed
      • Maximum Booking allowed in a given time slot
      • Maximum Booking allowed for a user in any given day
      • Maximum Booking allowed for a user in any given slot
    3. Payment Details – UPI Id
    4. Current Location Details (inclusive of your Latitude and Longitude)
    5. Detailed Address Information about other Entities managed or owned by you.
  8. Information collected by us from both the Primary and the Secondary User may include, but is not limited to, the following:
    1. Non - Personal Information i.e. Device details such as IP address, model number, Operating System, Log files, Error logs, Language, ISP Source, referral source, length of visit, cookies information, etc.
    2. Other hardware and software information.
    3. Date and Time of your access to the platform.
    4. Any other information willingly shared or entered by you.

3. Dissemination of Personal Information

  1. We as an intermediary Platform are responsible for only aggregating and facilitating the exchange of services between the Primary and the Secondary User, in which scenario, the Primary User avails of service(s) from the Secondary User. For a smooth experience, some details with respect to personal information are shared between both the Primary and the Secondary User via the Platform. However, in order to facilitate ease of payment and contactless transaction between both the Primary and the Secondary User, the LESSs Platform collects the UPI Id from the Secondary User/ Business Entity at the time of registration. Once a desired service is selected by the Primary User, subject to the presence of the UPI Payment apps on the Primary User’s mobile device, the LESSs Platform launches the UPI Payment app on the Primary User’s mobile device while the Primary User is attempting to make payment for the chosen service from a particular Secondary User/ Business Entity.
  2. In the same vein, the LESSs Platform also enables the launch of WhatsApp messenger and Google Maps, subject to its presence on the Primary User’s mobile device. The same is done to facilitate the Primary User to seek an online consultation with the Secondary User, if they so desire and if the same is being provided by the Secondary User. On the other hand, Google Maps allow the Primary User to locate the address of the Secondary User with ease.

Note: The LESSs Platform is not responsible for these financial transactions as it simply launches the already present UPI payment app on the Primary User’s mobile device in order to facilitate the payment towards a chosen service. Hence, BIGPIQ Technologies Private Limited does not take any payment fees for doing the same and neither is it responsible for the said payment as the same is done directly by the Primary User to the Secondary User.

4. Use of Your Information

We may use your information to:

  • Create and manage your account.
  • Enhance or improve User experience, for our App and to improve our Service.
  • Increase the efficiency and operation of the Application.
  • Resolve disputes and troubleshoot problems.
  • Email you regarding the service availed.
  • Respond to product and customer service requests, if any.
  • Monitor and analyze usage and trends to improve your experience with the Platform.
  • Notify you of updates to the Platform.
  • Request feedback and contact you about your use of the Platform.
  • Fulfil and manage purchases, orders, payments, and other transactions related to the Platform.
  • Perform any other function that we believe in good faith is necessary to protect the security or proper functioning of our Site or Service.

5. Third-Party Access to Your Information

  1. LESSs Platform connects Primary Users to Secondary Users/ Business Entities and in the process we may have to share the data with third party individuals, organizations or technological platforms, including contractors, web hosts, cloud servers, etc., to assist us for enhancing the performative functioning of the Platform.
  2. Throughout the course of our provision of our Service to you, we may delegate our authority to collect, access, use, and disseminate your information. For example, our web host stores the information that you provide us, and we may hire outside contractors to perform maintenance or assist us in securing our Platform.
  3. It is, therefore, necessary that you grant the third parties, we may use in the course of our business, the same rights that you accord to us under this Privacy Policy. For this reason, you hereby agree that for every authorization which you grant to us under this Privacy Policy, you also grant to any third party that we may hire, contract, or otherwise retain the services of, for the purpose of operating, maintaining, repairing, or otherwise improving or preserving our Platform or its underlying files or systems. You agree not to hold us liable for the actions of any of these third parties and that you may take legal action against them directly should they commit any tortious action or other actionable wrong against you.
  4. Without limiting the generality of the foregoing, you authorize us to collect, share, store, exchange, and otherwise use your information in conjunction with:
    • Apple App Store
    • Google Play
    • Google Analytics
    • Mail Chimp
    • AWS
    • Google Cloud
  5. We are not selling any personal data to any third-party. We will retain the data for only analytical purposes for a period of one year or longer in case of any requirement by the government or by the Order of the Court.
  6. Notwithstanding anything contained in this Privacy Policy or elsewhere in the Terms of Use, the LESSs Platform shall not be held responsible for any loss, damage or misuse of your Personal Information or data. Further, if such loss, damage or misuse is attributable to a Force Majeure Event, the same is beyond the reasonable control of the Platform and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer data and storage device, computer crashes, breach of security and encryption, etc.

6. Security

  1. We have implemented reasonable security practices and procedures including role-based access, secure communication, password protection, encryption, etc. to ensure that the Personal Information collected is secure. The same includes physical, administrative, technical, and electronic security measures to protect against the loss, misuse, and alteration of your data.
  2. Despite our best efforts, in the event that you think or believe your privacy has been breached, you may contact us immediately at hello@bigpiq.com
  3. Further, if you are the Manager(s)/Administrator(s)/Owner(s) of a particular Secondary User/ Business entity, you hereby acknowledge and agree that details about your Personal Information may be freely accessible by the Primary User or Manager(s)/Administrator(s)/Owner(s) of other Secondary Users/ Business Entities and we shall not be able to restrict, control or monitor access to your Personal Information by such users.
  4. We shall not be liable in any way with respect to any breach of security or unintended loss or disclosure of information caused to your Personal Information.

7. Permissions

Once you download and install the LESSs mobile application, you may be prompted to grant certain permissions to allow the Application to perform certain actions on your device. These actions include permission to:

  1. Access to Camera to scan the QR codes for faster access to the Services provided on the Platform.
  2. Read/write/modify/delete data about the LESSs Platform on your device’s storage.
  3. View/access information relating to networks/access networks, including permission to send and receive data through such networks/access networks.
  4. Determine your approximate location from sources such as, but not limited to, mobile towers and connected Wi-Fi networks;
  5. Determine your exact location from sources such as, but not limited to, GPS & IP.
  6. View/access device information, including but not limited to the model number, manufacturer details, IMEI number, operating system information, country, State, City, phone number.
  7. Access device information including device identification number required to send notification/push notifications.
  8. Calendar, Clock Access for reminders, etc.

Changes to the Privacy Policy

If our privacy policy changes in the future, the same shall be posted here and a new date will be updated here. You are suggested to read our privacy policy from time to time to ensure that you are updated with its current particulars.
